Thank you for trusting Los Angeles Surrogacy with one of the most meaningful decisions of your life — whether you're an intended parent building your family, a gestational surrogate offering an extraordinary gift, or an egg donor helping create new possibilities. We know that arriving at this page usually means you're serious about your journey, and we want these terms to feel like an honest conversation, not a wall of fine print.

By accessing or using this website, our Matching Suite Portal, or any of our surrogacy agency, egg donation, or intended-parent matching services (together, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our Services, and reach out to our team — we're happy to talk through any concerns before you commit to anything.

These Terms apply to all visitors, applicants, intended parents, surrogates, egg donors, and other users of losangelessurrogacy.com and our related services, in every state where surrogacy and egg donation are permitted under applicable state law.

• "Agency," "we," "us," "our" refers to Los Angeles Surrogacy and its officers, employees, contractors, and affiliated professionals.
• "Intended Parent(s)" means any individual, couple, or family — regardless of gender identity, sexual orientation, marital status, or country of origin — seeking to build their family through gestational surrogacy or egg donation.
• "Surrogate" or "Gestational Carrier" means an individual who has applied to, and been approved through, our surrogacy screening process to carry a pregnancy for intended parents.
• "Egg Donor" means an individual who has applied to donate eggs through our egg donation program.
• "Matching Suite Portal" means our secure client portal used to track journey milestones, documents, and communications.
• "Services" means matching, screening, coordination, and support services offered by the Agency — expressly excluding legal representation and medical care, as described in Section 3.

Los Angeles Surrogacy is a surrogacy and egg donation agency. We guide, match, screen, and coordinate — we do not provide medical care and we are not a law firm. Understanding this distinction matters, because it shapes who is responsible for what throughout your journey.

We connect intended parents with screened surrogates and egg donors, coordinate timelines between fertility clinics, escrow managers, and attorneys, and provide dedicated case management, emotional support resources, and guidance through every stage — from application to delivery and beyond. We do not perform medical procedures, provide fertility treatment, draft or negotiate legal contracts on your behalf, or guarantee any medical, legal, or emotional outcome.

We welcome intended parents from every background, and we hold surrogates and egg donors to thoughtful, medically-grounded standards designed to protect everyone in the journey.

Intended Parents: Any individual, couple, or family may apply, regardless of gender identity, sexual orientation, relationship status, or country of residence, subject to the surrogacy and egg donation laws of the state in which services are rendered.

Surrogates: Applicants must generally be between 21–40 years old, have previously carried and delivered a healthy pregnancy, maintain a stable home environment and healthy BMI range, pass comprehensive medical and psychological screening, and meet all additional surrogacy requirements described on our website and application forms.

Egg Donors: Applicants must generally be between 20–35 years old, in good reproductive health, and willing to complete our full egg donor application, medical evaluation, and screening process.

Meeting these baseline requirements does not guarantee acceptance into our program or a successful match — final approval depends on the outcome of screening described in Sections 5 and 7.

Every journey — parenting journey, surrogate journey, or egg donor journey — begins with an application. Submitting an application through our website or Matching Suite Portal does not create a binding agreement between you and the Agency, nor does it guarantee that we will accept you into our program or successfully match you with an intended parent, surrogate, or egg donor.

We use the information you provide, together with independent medical, psychological, financial, and background screening, to determine candidacy and to thoughtfully pair intended parents with surrogates and egg donors. Matching decisions are made in our sole discretion, taking into account medical guidance, personal preferences, timing, and the specific needs of each family.

You agree to provide accurate, complete, and truthful information throughout the application and matching process. Providing false or misleading information may result in immediate removal from our program without refund of any fees already incurred.

Surrogacy and egg donation involve legal rights that matter deeply — to you, and to the family or child at the center of the journey. For that reason, all intended parents, surrogates, and egg donors are required to retain their own independent legal counsel, licensed in the relevant jurisdiction, before signing any surrogacy or egg donation agreement.

Los Angeles Surrogacy does not provide legal advice, does not draft or review contracts on your behalf, and is not a party to any surrogacy or egg donation agreement entered into between intended parents and a surrogate or egg donor. We can refer you to reproductive law attorneys we trust, but the decision to retain counsel, and the terms of any legal agreement, remain entirely between you, the other party, and your respective attorneys.

Your health and well-being — and that of any future child — come first. Surrogates and egg donors must complete medical screening, psychological evaluation, and any additional testing required by our partnered fertility clinics before being matched or beginning treatment.

All medical care, fertility treatment, and psychological counseling is provided by independently licensed physicians, clinics, and mental health professionals — not by Los Angeles Surrogacy. We coordinate scheduling and communication between parties, but we are not responsible for diagnosis, treatment, or medical outcomes, and we make no representation regarding the success of any medical procedure.

Surrogacy compensation and egg donor compensation are important, sensitive topics, and we aim to be as transparent about them as possible. Compensation amounts, agency fee schedules, and third-party costs (including medical, legal, escrow, and insurance costs) are outlined separately in your program materials and applicable agreements, and may vary by program, state, and individual circumstances.

All surrogate and egg donor compensation is disbursed through an independent, licensed escrow or trust account managed by a third-party escrow provider — not held directly by the Agency. Agency service fees paid by intended parents are described in your services agreement; certain deposits and fees may be non-refundable once services have begun, as set out in that agreement. We encourage every client to review all fee and compensation terms carefully with their attorney before signing.

You agree to use our website and Matching Suite Portal only for lawful purposes connected to your surrogacy, egg donation, or intended-parent journey. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

• Do not attempt to access another user's records, documents, or portal account.
• Do not upload false medical, legal, or identifying information.
• Do not use our website or portal to harass, discriminate against, or misrepresent yourself to another party in the matching process.
• Do not copy, scrape, or repurpose website content, forms, or portal functionality without written permission.

We may suspend or terminate portal access for any violation of these Terms or for conduct that we, in good faith, believe puts another client, applicant, or the integrity of a match at risk.

Surrogacy and egg donation journeys are personal, and we treat the information you share with the same discretion we'd want for our own families. Our collection and use of personal, medical, and financial information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Intended parents, surrogates, and egg donors may, at points in the matching process, share limited personal information with one another (such as first names, general location, or medical history relevant to the match) with each party's consent. Beyond what is needed to support your match, we do not sell your personal information, and we ask all parties to treat information shared during the matching process as confidential.

We're proud to support intended parents around the world — hope, as we see it, shouldn't be limited by geography. Our surrogacy agency operates only in U.S. states where gestational surrogacy is permitted under applicable state law, and all matches, agreements, and medical procedures are conducted in compliance with the law of the state in which services are performed.

International intended parents are responsible for understanding and complying with the immigration, citizenship, and legal-parentage requirements of both the United States and their home country, including obtaining appropriate legal counsel in both jurisdictions. Los Angeles Surrogacy can coordinate logistics such as travel and genetic material transport, but does not provide immigration or foreign legal advice.

While we are deeply committed to walking alongside you at every step, Los Angeles Surrogacy makes no guarantee, warranty, or promise regarding: successful matching within any particular timeframe; the outcome of any medical procedure, embryo transfer, or pregnancy; the establishment of legal parentage; or the emotional experience of any party to a match. Every journey is unique, and outcomes depend on many factors outside our control.

All content on this website — including text, the Los Angeles Surrogacy name and logo, graphics, photography, and the design of our Matching Suite Portal — is owned by or licensed to Los Angeles Surrogacy and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages for your personal, non-commercial use during your application or journey, but may not reproduce, distribute, or create derivative works from our content without our prior written consent.

To the fullest extent permitted by law, Los Angeles Surrogacy, its officers, employees, and affiliated professionals will not be liable for any indirect, incidental, special, or consequential damages — including lost income, emotional distress, or medical or legal expenses — arising from your use of our Services, our website, or our Matching Suite Portal, or from the acts or omissions of any third-party medical provider, attorney, escrow agent, surrogate, egg donor, or intended parent.

Our total liability for any claim relating to our Services will not exceed the total agency fees you paid to us in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless Los Angeles Surrogacy and its officers, employees, and affiliated professionals from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or any information you provide to us or to another party during the application or matching process that you knew, or should have known, to be false.

You may withdraw your application or discontinue use of our Services at any time by notifying our team in writing; any refund of fees already paid will be governed by your services agreement. We may suspend or terminate your access to our website, Matching Suite Portal, or program participation if we determine, in good faith, that you have violated these Terms, provided false information, or engaged in conduct that endangers another party's safety, well-being, or the integrity of a match. Sections of these Terms that by their nature should survive termination — including Sections 13–17 — will continue to apply.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that any surrogacy or egg donation agreement between intended parents and a surrogate or egg donor will be governed by the law of the state in which the relevant medical and legal services are performed, as specified in that agreement.

Any dispute arising out of your use of our website or Services that is not otherwise resolved through informal discussion with our team will be resolved through good-faith mediation before either party pursues formal legal action, unless applicable law requires otherwise.

We may update these Terms from time to time as our Services, or the laws governing surrogacy and egg donation, evolve. When we do, we'll revise the "Last Updated" date at the top of this page. Continued use of our website or Services after changes are posted means you accept the updated Terms. For material changes affecting clients actively in our program, we will make reasonable efforts to notify you directly through your Matching Suite Portal or by email.
